In our review of over 2100 lawsuits, we did not see Capital Management Services as a plaintiff, but that doesn’t mean they don’t contract out their lawsuits to local firms.
When will a debt collector sue me?
There are a handful of reasons to attest to when a debt collector may sue someone. Here are some of the hypothesis for when a debt collector may sue:
- Do you have savings, checking, or investment account?
- How much total unpaid debt do you have? The more unpaid debt you have, the higher the chance you have of being sued.
- Do you have more debt than $2,000? Debt collectors tend to hold off on suing people with less than $2,000 unless their cost-benefit analysis says differently.
- Do you owe money to large or small businesses?
- One thing to do is to verify if your state allows wage garnishment, levies, or liens. Please check the bottom of this section to find out.
How do I know if I am going to be sued?
Sometimes it can be quite simple. Someone will hand-deliver the summons to your doorstep so that there is no confusion on if you received the court summons or not. If you decide to ignore the summons, collectors most likely will request a default judgment and get more than you want.
